Vendor waives all claims of every kind against Kimberly Vaughan Enterprises, LLC, show facility, and representatives of the same including, without limitation, all claims for damages based on personal property damage, destruction, loss or theft, personal injury or death, and any other act or failure to act of Kimberly Vaughan Enterprises, LLC. Vendor agrees to indemnify and hold Kimberly Vaughan Enterprises, LLC harmless from all claims, including expenses, damages, costs, legal, and attorney fees, by Vendor, Vendor’s agents, employees, contractors, heirs, or by any other person, arising out of any act or omission in any way related to Vendor’s participation in the event, whether negligent or not.
